Aarushi Murder Case: Krishna’s bail plea dismissed
Jun 30th, 2008 | By Sindh Today | Category: India, PopularA Ghaziabad court on Monday (June 30) has rejected the bail application of Talwar’s compounder Krishna on the ground that Magistrate court is not entitled to hear bail maters in cases involving crimes which requires punishments with the maximum of death and minimum life in prison.
Filing a plea bail, Krishna lawyer said that his client has been in illegal detention since May 16 and has been subjected to various medical and scientific tests without his wishes.
CBI countered the defense argument and said that the case does not fall under sub-section of CrPC 437. he further said that Under this section, bail can be granted by the Magistrate only if the accused is under age of 16 or medically unfit. Such is not the case in this matter
